    Managing Public Holidays

    At first glance, public holidays are not very complicated. They refer to a national, cultural, or religious holiday on which workers are legally entitled to time off. 

    In Canada, as elsewhere, the various laws on labour standards include obligations that must be respected. These laws protect employees and workers in their right to benefit from a paid vacation. 

    In Quebec, the law provides for 8 public holidays per year: 

    • January 1 (New Year's Day);
    • Good Friday or Easter Monday (employer's choice);
    • The Monday before May 25 (National Patriots Day);
    • June 24 (Quebec's national holiday);
    • July 1st or July 2nd if the 1st is a Sunday (Canada Day);
    • The 1st Monday of September (Labour Day);
    • The 2nd Monday of October (Thanksgiving);
    • December 25th (Christmas Day).

    However, managing vacations is more complex than it seems. Here are some rules to remember: 

    • For hourly paid employees, the holiday compensation is 1/20th of the wages earned in the previous 4 weeks, not including overtime;

    • If the employee works on a public holiday, the employer will pay the employee his or her regular wages for the work performed. In addition, the employee is entitled to holiday pay or time off on another day within 3 weeks before or after the holiday. 

    • If the employee is already on vacation during a public holiday or it is a day the employee is usually off, the employer must pay the employee holiday pay or give the employee time off again. If vacation pay is paid on vacation or leave of absence, no overtime is generated as no insurable hours are to be recorded;

    • An employee who is absent the day before or after a holiday without the employer's permission will not receive holiday pay for that holiday.
